| Oregon governor proposes vehicle mileage tax tiedyejeremy writes "As covered by the Crosscut Blog, the Governor of Oregon, Ted Kulongoski, is proposing a change in the funding of the Oregonian transportation system that drops gasoline taxes and, by way of GPS tracking, taxes the number of miles driven, to the tune of 1.2 cents per mile. The reason for the proposed change is that lower fuel consumption via fuel efficiency will leave the system underfunded. The concerns involve government tracking of the movements of vehicles within the state, though this has been denied by ODOT official, James Whitty. I'm wondering how this affects people using the Interstate System and private roads, and if the outputs can or will be used by law enforcement to check alibis." Raleigh, an RIAA case pending in St. Louis, Missouri, the defendant has asserted detailed counterclaims against the RIAA for federal RICO violations, fraud, violation of the Computer Fraud and Abuse Act, prima facie tort, trespass, and conspiracy. The claims focus on the RIAA's 'driftnet' tactic of suing innocent people, and of demanding extortionate settlements. The RICO 'predicate acts' alleged in the 42-page pleading (PDF) are extortion, mail fraud, and wire fraud. The proposed class includes all people residing in the US 'who were falsely accused ... of downloading copyrighted sound recordings owned by the counterclaim Defendants and making them available for distribution or mass distribution over a P2P network and who incurred costs and damages including legal fees in defense of such false claims' or 'whose computers used in interstate commerce and/or communication were accessed ... without permission or authority.' This is the second class action of which we are aware against the RIAA and the Big 4 recording companies, the first being the Oregon class action brought by Tanya Andersen, which is presently in the discovery phase." | Rubber duckies for global warming research The Wall Street Journal has a look at global warming research using rubber duckies. The toys have been employed in tracking ocean currents since 1992; but recently NASA robotics expert Alberto Behar released 90 yellow rubber ducks into the melt water flowing down a chasm in a Greenland glacier. "Each duck was imprinted with an email address and, in three languages, the offer of a reward. If all goes well, Dr. Behar hopes that one day they will emerge 30 miles or so away at the glacier's edge in the open water of Disko Bay near Ilulissat, bobbing brightly amid the icebergs north of the Arctic Circle, each one a significant clue to just how warming temperatures may speed the glacier's slide to the sea." Does 1-17, the RIAA's case targeting students at the University of Oregon, the Oregon Attorney General's motion to quash the RIAA's subpoena — pending for about a year — has reached a perplexing conclusion. The Court agreed with the University that the subpoena, as worded, imposed an undue burden on the University by requiring it to produce 'sufficient information to identify alleged infringers,' which would have required the University to 'conduct an investigation,' but then allowed the RIAA to subpoena the identities of 'persons associated by dorm room occupancy or username with the 17 IP addresses listed' even though those people may be completely innocent. In his 8-page decision (PDF), the Judge also 'presumed' the RIAA lawyers' misrepresentations were an 'honest mistake,' made no reference at all to the fact, pointed out by the Attorney General, that the RIAA investigators (Safenet, formerly MediaSentry) were not licensed, rejected all of the AG's privacy arguments under both state and federal law, and rejected the AG's request for discovery into the RIAA's investigative tactics." | Nasa uses rubber ducks in climate study NASA researchers have dropped 90 rubber ducks into holes of Greenland's fastest moving glacier: the Jakobshavn Glacier in Baffin Bay. Scientists are unsure as to why glaciers speed up in the summer months. One theory is that the summer sun melts ice on the surface of the glacier, which creates pools of water, which then flow into moulins -- narrow tubular shafts in the glacier. These then transport the water from the top to the underside of the glacier. The rubber ducks, labeled with the words "science experiment" and "reward" in three languages, along with an email address, may provide some answers. | Don't share that law! it's copyrighted Nathan Halverson writes "California claims copyright to its laws, and warns people not to share them. And that's not sitting right with Internet gadfly, and open-access hero, Carl Malamud. He has spent the last couple months scanning tens of thousands of pages containing city, county and state laws — think building codes, banking laws, etc. Malamud wants California to sue him, which is almost a given if the state wants to continue claiming copyright. He thinks a federal court will rule in his favor: It is illegal to copyright the law since people are required to know it. Malamud helped force the SEC to put corporate filings online in 1994, and did the same with the patent office. He got the Smithsonian to loosen its claim of copyright, CSPAN to stop forbidding people from sharing its videos, and most recently Oregon to quit claiming copyright on state laws." Malamud's talk at Google ("All the Government's Information") is also well worth watching. Don't share that law! it's copyrighted
